Custody Arrangements in New Jersey
There are two types of custody in New Jersey: legal custody and residential custody (what other states call physical custody). Legal custody involves who can make important decisions about a child (e.g. medical, religious upbringing, education, etc.). Residential custody deals with where the child resides or where the child is physically located.
There are three types of residential custody: joint, shared and traditional. A parenting time schedule where one party has the children most of the time and the other parent enjoys alternating weekends and one or two visits during the week is generally referred to as traditional. Joint custody is 50/50 or very close to a 50/50 split. Shared is generally 75/25 or 65/35 (where both parents have a somewhat significant amount of time with the children, but not 50/50).
